S. 1213
Children's Express Lane to Health Coverage Act of 2007
Lugar/Bingaman-Introduced 2007 but not passed
This bill has been introduced by Senators Lugar (R-IN) and Bingaman
(D-NM). The bill gives states the option to implement Express Lane and
more easily reach children who are eligible for Medicaid and SCHIP but
not enrolled. In particular, it would give states the flexibility to use
findings that were made by nutrition assistance or other public programs
serving low-income children (findings such as income and assets, despite
differences in methodology) as the basis for making a Medicaid or SCHIP
eligibility determination. The bill also provides states with financial
support for improvements to their eligibility technology that would
allow for genuinely streamlined enrollment systems as well as enhanced
verification and administrative efficiency.

Lugar/Bingaman- 2005
This bill would give states the option to find children income-eligible
for Medicaid or SCHIP based on the fact that they are already enrolled
in another public means-tested program. The intent of the bill is to
allow states the flexibility of implementing an automatic Express Lane
Eligibility program that would make it easier for uninsured but eligible
children to enroll in Medicaid and SCHIP. This bill was introduced in
2005 but not enacted.

Kerry- 2005
Included in this comprehensive child health coverage legislation is a
provision that would allow states the option to find children
income-eligible for Medicaid or SCHIP based on the fact that they are
already enrolled in another public means-tested program. The
Express
Lane provision is part of a multi-faceted
effort to streamline the enrollment process, including other measures
such as requiring states to adopt 12-month continuous enrollment, accept
self-declaration of income, and remove the assets test. This bill was
introduced in 2005 but not enacted.

Bingaman/Rodriguez- 2002
Subtitle D, Section 131 of this Act would allow states to deem children
to have met Medicaid's financial eligibility requirements based on a
determination of income and resources by another Federal or State agency
within the prior twelve months, as long as the agency bears a real or
potential fiscal impact from that determination. This proposal is part
of comprehensive legislation to improve and fund health coverage for
low-income families, especially those in the Hispanic community. This
bill was introduced in 2002 but was not enacted.

and H.R. 1990 (PDF) 2056 KB
Dodd/Miller- 2002
Section 1121(a)(E) of this Act would require states to coordinate
enrollment of children under Medicaid and SCHIP with enrollment in other
Federal means-tested public assistance programs. This proposal is part
of comprehensive legislation to improve all children's services that was
introduced in 2001 but was not enacted.
P.L. 106-224 Agricultural
Risk Protection Act of 2000
Combest- 2000
Subtitle E, Section 242 of this Act amended the National School Lunch
Act to facilitate disclosure of contact and eligibility information from
school lunch applications to Medicaid and SCHIP agencies. This law
allows schools and school districts to share school lunch information
with the state health insurance agencies for outreach and enrollment
activities without obtaining parental consent. The law, enacted in 2000,
stipulates that parents or guardians must be notified and given the
opportunity to elect not to have their children's eligibility
information disclosed to Medicaid or SCHIP.
